The coming into effect of the Protection of Personal Information Act No. 4 of 2013 (referred to as “POPIA”) on 1 July 2020 sets conditions for how information can be processed. POPIA aims to ensure that Personal Information is processed in line with internationally accepted data protection principles. This Privacy Policy is in terms of the POPIA.

POPIA is intended to protect both natural and juristic persons (Data Subjects) from harm by protecting their personal information. POPIA ensures that all websites, companies, and organisations (Responsible Parties) that hold and process personal information do so carefully and with respect for the rights and interests of the data subjects.

This Privacy Policy of Getupgurl regulates how we collect and use the information that we have about all our customers, suppliers and employees and your rights in this regard. Your right to privacy is important to us and therefore, we set out to treat your personal information as private and confidential. We are committed to taking steps to protect your privacy when you use our website, services and/or materials provided by us, and we apply business practices that comply with the POPIA. In this Privacy Policy, we explain how we will use and protect your Personal Information in terms of Applicable Law.

Without your personal information, we may not be able to provide you, or continue to provide you, the products and/or services that you need.

Where we refer to “Personal Information” we mean personal information as defined in POPIA, being information that may be used to directly or indirectly identify you, whether as a natural or juristic person. Personal Information includes, for example, your name, surname, email address, identity number, contact details, photograph, and location and for juristic person it will include company registration number, symbol, e-mail address, physical address, telephone numbers, location information, online identifier or other particular assignment to the juristic person.

Links To Third Party Websites

We may provide links to third-party websites including (without limitation) social media platforms, payment gateways, appointment scheduling and/or live chat platforms for the convenience of our users. Getupgurl does not control these third-party websites and cannot represent that their policies and practices will be consistent with this Privacy Policy. If you use or rely on any links on our website, you do so at your own risk. We encourage you to review the privacy policies of any third-party website before submitting any of your personal information.

Refusal to provide us with Information

In circumstances where you refuse to provide us with information that is required by us to perform the service or provide the product to you for purposes of the contract, we will have to terminate our services, and notify you.

Processing of Information on our E-Commerce Store

4.1 For purposes of concluding the contract that you have agreed to by making use of our website, purchasing our goods and/or employing our services we will verify your identity for security purposes, sell products to you, provide you with our services.
4.2 By virtue of our contractual relationship, we will also provide you with suggestions and advice on products, services and how to obtain the most from using our website.
4.3 All information that you provide to us in course of the contract will continue to be processed by us, until the contract terminates, or if you have consented to receiving further information from us until unsubscribed.

5.1 Through certain actions when otherwise there is no contractual relationship between us, such as when you browse our website or ask us to provide you more information about our business, including our products and services, you provide your consent to us to process information that may be personal information.

We can process information that we have a lawful interest to process. 12.2 Any request for the removal or amendment of information may be directed to our information officer who will ensure that your information is removed or updated on our database.
12.3 It however, remains your responsibility to inform us of any information that must be updated or removed.

Information of Children

13.1 Our products or services are not for sale for children or minors under the age of 16.
13.2 We however collect information of all users of our website and cannot guarantee that the information of a minor will not be collected in terms of this privacy policy.

We use Secure Sockets Layer (SSL) certificates to verify our identity to your browser and to encrypt any data you give us.

App Subscriptions, Cancellations & Refunds

What you need to know about Getupgurl App subscriptions, cancellations & refunds:

  • YOU MUST MANUALLY CANCEL YOUR SUBSCRIPTION on your phone’s settings/in your app store yourself, before the renewal date. This also applies to the Getupgurl App.

  • All apps will continue with deductions until you cancel it, regardless of whether you decided to renew or not. This also applies to the Getupgurl App.

  • Please do NOT rely on an email notification to inform you that your subscription is about to renew.

  • Deleting/uninstalling the app from your phone does NOT equate to canceling your subscription.

  • Since you are not required to cancel your subscription within the Getupgurl App, you can cancel your subscription even if you have forgotten your login details.

If you’d like to cancel your subscription, go to one of the following on your phone:

  • Settings to see & cancel your purchases.

  • App store where you registered & filled in your bank details.
